1. Parties and Scope: This agreement is concluded electronically between the site operator (Operator) and the registering user. It is governed by applicable national law (including Turkish Penal Code Art. 26–27, Turkish Commercial Code, Law No. 5651 on Regulation of Publications on the Internet, KVKK, e-commerce legislation) and international instruments (EU e-Commerce Directive 2000/31/EC, GDPR, UNCITRAL Model Laws, Hague Conventions, and equivalent liability-limiting frameworks).
2. Intermediary Status and Limitation of Liability: The platform provides technical intermediation only (hosting/access-provider type services). Under Law No. 5651 and equivalent national and international provisions, the Operator is not liable for user-generated content, listings, transactions, escrow dealings, or disputes between users or with third parties. All legal and criminal liability rests solely with the user. The Operator acts in an intermediary capacity and cannot be held liable for user conduct.
3. Legal Compliance and User Obligations: The user agrees not to post content or engage in conduct that violates applicable criminal or civil law (including fraud, defamation, privacy violations, computer misuse). Any legal, criminal, or administrative liability for such conduct lies exclusively with the user. The Operator shall in no event be held liable for such acts.
4. Absolute Protection of the Site Owner (Operator): This agreement is intended to protect the Operator to the fullest extent under applicable national law (Turkish Penal Code, Law No. 5651, Turkish Commercial Code) and international law (EU e-Commerce Directive, GDPR, UNCITRAL, Hague Conventions, and principles analogous to intermediary liability protections). The user acknowledges that the platform is merely an intermediary; that the Operator is protected from all user-originated claims, lawsuits, administrative or criminal proceedings, and indemnity demands; and that the Operator may under no circumstances be held liable for users’ actions, violations, or relations with third parties.
5. Indemnification and Waiver: The user agrees to fully indemnify the Operator against any claims, suits, criminal complaints, administrative sanctions, and costs (including legal and court costs) arising from or related to user conduct. The user undertakes the broadest possible indemnity and waiver in favour of the Operator; this clause is valid under all applicable laws, including international custom and lex mercatoria.
6. Disclaimer and Limitation of Liability: The platform is provided “as is.” The Operator gives no warranty that the service will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, the Operator disclaims liability for indirect, incidental, special, or punitive damages; internationally recognised limitation-of-liability principles apply.
7. Governing Law and Jurisdiction: The law of the Republic of Turkey (and, where applicable, the Operator’s place of establishment) governs disputes arising from this agreement. For the Operator’s benefit, the courts and enforcement authorities at the Operator’s seat or the place of the platform’s administrative centre have exclusive jurisdiction. International arbitration or foreign court decisions shall be interpreted in favour of the Operator where not contrary to Turkish public policy.
8. Acceptance: By completing registration, the user is deemed to have read this entire text and to accept that the site owner is strongly protected under the Turkish Penal Code, Law No. 5651, and international law.
